Section 9, The Role of the Looked After Review in Achieving Permanence for the Child has been amended to reflect the outcome of a High Court Judgement in respect of children who were subject to Section 20 and where there were concerns of significant delays in their planning for permanence. Social Worker Visits to Looked After Children Section 2, Exceptions has been revised to set out more clearly the circumstances where visiting requirements differ from those set out in Section 1, Normal Frequency. Leaving Care Policy

This chapter has been comprehensively amended to reflect the Children and Social Work Act 2017 on the Leaving Care Services and Care leavers. Particularly:

  • The Local Offer - all local authorities must publish up-date information about the services it offers for care leavers and other services which may assist care leavers in, or preparing for, adulthood and independent living;
  • Corporate parenting: the Children and Social Work Act 2017 establishes 7 Corporate Parenting Principles, which should include and involve not only the Local Authority providing Children's Social Care services, but also District Councils (where appropriate) and partner agencies;
  • Continuing Support Up to the Age of 25: all Care leavers between the ages of 21 and up to 25 will be entitled to support irrespective of whether they are in education or training. Even when they may not initially choose such support, they can return and seek support, which can be provided on specific issues or on a more comprehensive basis where this is needed.
The chapter also reflects the adjustments required following the introduction of the UK GPDR and Data Protection Act 2018.
Adoption and Permanence Panel This guidance has been reviewed and updated following the introduction of the UK General Data Protection Regulations (UK GDPR) and Data Protection Act 2018.

Children in Need Plans and Network Meetings - Practice Guidance  This chapter has been updated to acknowledge that children subject to Supervision Orders as a result of care proceedings or private law proceedings should be identified as children in need. A meeting should be held in a timely way before the Order expires.
Young Carers This chapter has been extensively revised with regard to providing guidance on identifying and supporting young carers. Since April 2015, local authorities have had a duty to take 'reasonable steps' to identify children in their area who are young carers, and to determine if they need support. Local authorities must carry out an assessment whenever it appears that a young carer has a need for support (this could be either in their capacity as a young carer or in a more general sense as a child or a young person). This assessment is called a Young Carer's Needs Assessment.

Deprivation of Liberty Guidance This chapter has been amended with regard to the 'deprivation of liberty' to children under 16 years. Parental consent should be sought for children subject to Section 20; where a care order is in place an order from the court is required. In some circumstances a Restrictive Intervention Risk Assessment (RIRA) should be completed and signed by parent/carers and relevant professionals (See Section 5, Under 16 year olds).
Brighton and Hove Policy on Missing Children This chapter has been revised to reflect the current organisational structure and to add a Flow Chart and guidance from the Sussex Police (see Relevant Local Policies and Procedures). The chapter also acknowledges the 'Weekly Missing Meetings' (see Section 9, Information Sharing and Notification).
Brighton and Hove Missing from Home Practice Guidelines This chapter has been significantly amended throughout: Brighton and Hove has adopted the Sussex Police Missing Children Reporting Procedure which includes guidance on assessing risk. Section 4, Agreed Procedure when a Child goes Missing has been fully amended, as has Section 5, Strengthening Families Assessment's, which focusses on Triggers for undertaking a Strengthening Families Assessment. A flow chart has also been added to assist in clarifying the procedure (see Appendix 1: Procedure for When a Child/Young Person is Missing from Home or Care Flowchart).
Brighton and Hove Missing from Care Practice Guidelines This chapter has been revised to amend the definition of 'Missing' and to confirm that the Sussex Police procedure is followed (see Section 3, Procedures to be Followed). This section also confirms the actions and procedure to be followed when Looked After Children go missing. In some circumstances it is thought best for the social worker to undertake the Section 5, Return Interviews.
Young People's Accommodation and Support Pathway: Missing Children (16/17 year olds) in Supported Accommodation Procedure This chapter has been significantly revised and amended throughout to reflect that Brighton and Hove follow the Sussex Police Missing Children Reporting Procedure (see Relevant Guidance.) Additionally, the chapter includes the Procedure for When a Child/Young Person is Missing from Home or Care Flowchart.
Decision to Look After and Care Planning This chapter has been amended to reflect the outcome of an Appeal Court hearing (2017) with respect to 'consent'. The court recognised that the term 'consent' itself was not used in Section 20. However, it described previous court observations as 'good practice guidance', emphasising its judgment should not alter the content or effect of these (see Section 1.3.1, Obtaining Parental Consent).
Placements with Parents Section 3.2, Assessment and Checks before Placement has been updated to reflect that the DBS has no eligibility for a standard or enhanced check for birth parents or other adults living in the household. However, the Local Authority has a requirement under the Care Planning, Placement and Case Review (England Regulations) 2010 to obtain information about unspent convictions and cautions before placing a child back with parents, and so other avenues can be explored. Additionally, Section 3.2, Assessment and Checks before Placement has been updated to include consideration should be given as to whether the home environment is safe for the child including where relevant, the need for a risk assessment of any pets and the environment in which they are kept.
Family and Friends (Connected Persons) This chapter has been updated to reflect that when placing a child with a Connected Person an initial risk assessment of any pets, together with the environment in which the pet is kept, should be taken into account (see Section 2, Assessing the Suitability of a Connected Person).
Applications for Special Guardianship Orders This chapter has been updated to acknowledge that should a child subject to Special Guardianship Order die, the responsibility for funeral arrangements reverts to the parents or other person with parental responsibility (see Section 16, Special Guardian Duty on the Death of the Child).
Social Visits (Including Overnight Stays) This chapter has been extensively updated, including the re-titling of the chapter, following a review of the information, in order to focus on the key issues around a Looked After Child's social contacts.

Supervision and Support of Foster Carers Section 5, Support Provided by the Supervising Social Worker (During Placement) has been updated to reflect that the Safer Caring Plan, any changes in household circumstances along with any health and safety issues including the addition of any new pets and the environment in which they are kept should be reviewed as required. Adoption and Permanence Statement of Purpose This statement has been fully reviewed and updated throughout and now reflects the structure of the Department and respective roles.
Assessment and Approval of Prospective Adopters

Section 5.3, Assessments has been updated to include where the applicants have pets, a risk assessment should be conducted and any associated risks should be taken into account with regard to the pet itself and where the pet is kept. Where necessary, an independent assessment should be undertaken by a vet to establish whether the dog falls within the scope of the Dangerous Dogs Act 1991.

Young Carers This chapter has been added to the manual. Young Carers (Needs and Assessments) Regulations 2015 came into force on 1st April 2015. The local authority are expected to take 'reasonable steps' to identify young carers in their area and undertake a 'Young Carer's Needs Assessment'. The chapter reflects the keys issues and processes that need to be undertaken when completing the assessment.
Ceasing to Look After a Child

This chapter has been added to the manual. This chapter reflects the statutory guidance 'Ceasing to look after a child' in 'Care Planning, Placement and Case Review Regulations (2015)' as amended by the 'Care Planning and Fostering (Miscellaneous Amendments) Regulations 2015' together with Working Together to Safeguard Children 2015.

The Local Authority has a duty to ensure that when children have been Accommodated under Section 20 (Children Act 1989) and are discharged from, or leave care, that the discharge is in their best interests and that they will be safeguarded and their welfare will be promoted. Where a child has been Accommodated for 20 days or more, the decision should be made by a Nominated Officer, or Director of Children's Services if the child/young person is 16/17 yrs and has been Accommodated under Section 20, before discharge.
Fostering for Adoption, Concurrent Planning and Temporary Approval as Foster Carers of Approved Prospective Adopters

This chapter has been introduced into the manual. This chapter seeks to deal with placement of a child with carers who are dually approved, i.e. approved both as prospective adopters and as local authority foster carers and the working understanding of concurrent planning for early placement of children within legal proceedings; (please note that where concurrency or foster to adopt is being considered in a Section 20 case, legal advice should be sought).

The Children and Families Act 2014 imposed a duty upon local authorities to consider placement with dually approved carers whenever it is considering adoption or where the decision has been made that the child ought to be placed for adoption.
Looked After Children and Young People in Contact with Youth Justice Services This chapter has been introduced into the manual. This chapter has been significantly updated throughout to reflect changes to the Police and Criminal Evidence Act 1984 (PACE) which defines 'arrested juvenile' for the purpose of Part 4 of that Act (detention). It focuses on young people who are thought to have offended and would otherwise be in police custody or who are remanded. Whenever the police detain a child or young person (aged 10 to 17), or interview them as a voluntary attender, they must inform an Appropriate Adult as soon as is practicable and ask them to attend (see Section 2.1, Safeguarding Children and Young People in Police Custody). Children's Services: Pre-Birth Assessments This chapter details a range of issues that surround pre-birth conferences and details when assessments and child protection planning (including legal action) should be considered – detailing key thresholds. As well as identifying key processes, the chapter also details the difference between the Early Parenting Assessment Programme (EPAP) and the Family Nurse Partnership (FNP) and provides additional tools for the assessment.
Practice Guidance for Working with and Supporting Families who have No Recourse to Public Funds This chapter describes the assessment process and criteria regarding those who have no recourse to public funds and those who may be entitled to support with regard to finance and housing. The chapter acknowledges the complexity of this area of work and that the criteria itself is one that does change. In certain instances, joint working and co-operation between Pods is required to ensure that the NRPF issues are dealt with. Please fully re-read.
Guidance in Relation to Asylum Seeking Families at Risk of Destitution This chapter focuses on the issue of the provision of financial (and other) resources when families are deemed to be destitute within the definition provided by Section 95 of the Immigration and Asylum Act 1999. There is a careful balance between a local authority carrying out its duties within the Act in terms of meeting needs bit also being compliant with Section 122 which prevents the provision of financial assistance in certain instances. The chapter identifies the process that needs to be followed and which includes effective communication with the Home Office.
Deprivation of Liberty Guidance This chapter seeks to provide clarity and guidance in a difficult and complex area of work. The Mental Capacity Act 2005 applies to all young people who are 16 yrs plus who are assessed as being unable to make key decisions for themselves. However, mental capacity is always assumed unless it is established otherwise and that all reasonable steps have been undertaken to assist them. Any actions taken must be made in the person's best interests and must be the least restrictive possible.
Placements in Foster Care and Residential Care

This procedure applies to all placements of children in foster care including placements with independent fostering agencies and children's residential care. It details the key processes required and expected both locally and nationally when seeking a Placement for a child or young person.

This can sometimes become a challenge in itself and detract from the main focus of the task. Where this is likely, careful thought is required to ensure there is a proper balance between parents' rights and confidentiality.
Guidance on the Use of Written Agreements by Social Workers This chapter details the use and limitations of the 'Written Agreement' and makes important distinctions from 'Written Undertakings'. Both are made frequently when seeking to clarify expectations around working with families. Nevertheless, understanding the nature of these agreements, particularly in some circumstances is important. This chapter has been reviewed as a result of an SCR and should be read in entirety.
Emergency Duty Service This chapter has been fully revised to provide updated material and contact details for the EDS which are relevant to social care practitioners in managing potentially serious ongoing concerns that might arise after hours.
Young People's Accommodation and Support Pathway: Missing Children (16/17 year olds) in Supported Accommodation Procedure This chapter focuses on young people 16/17 yrs, who are in supported accommodation and who go missing. Young people in this group can be particularly vulnerable and a clear balance needs to be identified between allowing young people appropriate freedoms as part of their growing up, whilst acknowledging the risks for them and that those seeking to support them may need to exercise an appropriate 'parental role'.
Use of 'Unsuitable Accommodation' for Young People aged 16 – 21 yrs This chapter seeks to identify and address those occasional situations when a young person has to be placed in temporary or 'Bed and Breakfast' accommodation on an emergency basis. In this situation, two establishments have been identified that are regularly inspected. Young people in such placements will be visited daily and receive additional support.

Sexual Exploitation

This chapter has been updated to include information about the Child Sex Offender Review (CSOR) Disclosure Scheme. This is designed to provide members of the public with a formal mechanism to ask for disclosure about people they are concerned about, who have unsupervised access to children and may therefore pose a risk.

Also, Sexual Harm Prevention Orders (which can be applied to anyone convicted or cautioned of a sexual or violent offence, including where offences are committed overseas) and Sexual Risk Orders (that can be made where a person has done an act of a sexual nature as a result of which there is reasonable cause to believe that it is necessary for such an order to be made) (see Section 10, Legislative Framework).

Life Story Policy and Guidance

This chapter replaced the previous chapter in entirety. The chapter contains two links to documents that detail the importance and purpose of 'Life story work' for a child, viz helping them to understand their past, present and future, as well as acknowledging the legal imperative for this work. This work needs to be carried out several times during the child's life as they mature and need to have different levels of information and understanding about themselves.

The chapters detail also the model of practice and the process for the work and the 'Practice Guidance for Children's Social Workers when commissioning and producing life story material for children with a plan for adoption' link provides more specific ideas and examples.
Leaving Care Policy This chapter has been updated in line with Children Act 1989 Guidance and Regulations - Volume 3: Planning Transition to Adulthood for Care Leavers (revised May 2014).
