7.2.13 Young People Homelessness Guidance

Overview

Young people who are Homeless or are threatened with Homelessness may have legal rights to stay in, or return to their Home. They may also be entitled to emergency or Temporary Accommodation (TA) from the councils housing department and or help from Social Services. They should be referred to the Councils Housing Options Team at the first opportunity to determine whether Homelessness can be prevented.

1. Housing Options Team

The Housing options Team work with people who are Homeless or threatened with Homelessness, and considered likely to be in Priority need (as set out below). They operate a prevention strategy, and work to prevent service users becoming Homeless by:

  • Negotiating with landlords with a view of notices being withdrawn.
  • Negotiating with relevant services (eg environmental Health, Housing benefit) in order for the client to remain in their current accommodation.
  • Assisting with accessing supported accommodation for vulnerable adults.
  • Supporting with accessing private accommodation in the form of loans for a deposit.

If it is not possible to prevent Homelessness, the client will be referred to the Homeless Persons Unit (HPU), who will process a Homeless application.


2. The Councils Duty to provide Emergency/Temporary Accommodation

The HPU work under the 1996 Housing Act part VII, (amended by the Homeless Act 2002). Which sets out the legal duty to provide temporary and permanent housing to Homeless people.

Being young and Homeless does not necessarily mean that the Local Authority has a legal obligation to provide accommodation. In line with s188 of the aforementioned Act, the local Authority have a duty to provide emergency accommodation if the following criteria is met.

  1. Eligibility

    Clients will normally be eligible if they are a British Citizen, a commonwealth citizen who have the right to live in the UK, or citizen of the member state of the European economic area. Clients are not eligible for assistance if they are not habitually resident in the UK, Ireland, Isle of Man or Channel Islands or if they are subject to immigration control.

  2. Homeless

    People are considered as Homeless if they have no legal right to occupy accommodation anywhere in the world, or if they are threatened with Homelessness within 28 days. They also meet the criteria if their current accommodation is considered unreasonable to occupy.

  3. Priority Need

    Clients are considered in priority need if they meet one or more of the following:
    1. Have a dependent child living with them, or might reasonably be expected to live with them.
    2. Pregnant or might reasonably be expected to live with a pregnant woman.
    3. 16 or 17 and not receiving certain help from Social Services, or under 21 and previously receiving certain help from Social Services.
    4. Homeless because of an emergency, fire, flood or other disaster.

You will also be in Priority Need if you are ‘Vulnerable’ because of

  • Old age, mental illness or disability, physical disability or some other special reason.
  • Have had accommodation from Social Services
  • Have been in the armed forces
  • Have served time in prison
  • Have had to leave your Home because of violence or threats that are likely to be carried out.

If the client meets all 3 of the above elements, (Eligible, Homeless and in Priority Need), of legislation that have a legal right to be housed in Temporary Accommodation whilst the HPU investigate a Homeless application.


3. Duty to Provide Permanent Accommodation

The Local Authority has a duty to provide Permanent accommodation for Homeless people when an s193 duty has been accepted towards them. This is the case when the client meets the above criteria, plus the following two:-

  1. Intentionality

    The council needs to be satisfied that the customer has not lost his/her previous settled accommodation due to a deliberate act or omission.

  2. Local connection

    Clients have a local connection with the Local Authority if:-
    1. They are living, or have lived in the area, for six out of the last 12 months, or 3 years out of the last 5 years.
    2. They are employed in the area (although not casual work or employed in the armed forces).
    3. They have family associations within the area (Parents, adult children, brothers/sisters, who have lived in the area for 5 years).
    4. They can prove special circumstances, which the council may consider on an individual basis.

If the clients meet these criteria, the Council will have a legal obligation to provide permanent accommodation


4. Young People Accepted as Homeless

If a client is 16/17 years old and accepted by the Local Authority, they are likely to be provided with supported accommodation until they are 18, when they can legally hold a secure Local Authority/registered Social landlord tenancy. Whilst accommodation is being sought and the client’s needs are being assessed, the young person will be offered temporary accommodation.

In emergency situations the Temporary Accommodation offered maybe a B&B style accommodation, and on some occasions maybe in Eastbourne. The Councils own Temporary Accommodation may also be provided. These often consist of bed-sit accommodation with shared bathroom/toilets.

Once a client is 18 they can then apply to the Housing register and follow the Home move scheme and bid for vacancies


5. Homemove Scheme

How the Homemove scheme works

Instead of the council allocating Homes, clients look for their own Home using the Homemove website, or the Homemove freesheet.

There are five steps to follow:

Step1 - Membership

Clients are automatically a member of Homemove if they are an existing tenant of Brighton & Hove City Council or any of our partner housing associations and have registered for a transfer or if they are a Homeseeker registered on the Joint Housing Register.

Step 2 - Registration

Once the council has accepted clients onto the register, Homemove will write to them with a Homemove number and what band (A, B, C or D) they have been placed in, Band A being the highest priority.

Step 3 - Choosing

Available properties are advertised on the website and in the Homemove freesheet. The adverts give information about each property available for letting.

You can pick up a free copy of Homemove from various places, including council offices and public libraries.

Once you have logged in to our bidding section or got your copy of Homemove, you will be able to ‘bid’ for a maximum of three properties in each edition.

You can bid using any one of these four ways:

  • Logging in to the bidding section of the website
  • By coupon - we send blank coupons direct to the client with the registration pack.
  • By telephone - call 0906 294 2036 and follow the instructions
  • By text - text 07781 472726

Homemove is usually published every other Friday and bids must reach us by 2pm the following Wednesday.

Step 4 - Offer

Homemove puts the bids received for each property advertised in priority order to produce a list of eligible members for each property.

The council’s allocations team will allocate from the list after doing further eligibility checks. The person whose name is at the top of the list will be invited to view the accommodation.

If the property is refused, the next person on the ‘priority list’ will be invited to view the property.

Step 5 - Feedback

All properties are listed on the ‘Feedback’ page of the Homemove freesheet once they have been let. The feedback tells you how many people bid for each property, as well as the band and registration date of the successful bidder. It is not possible to notify individuals when your bids have been unsuccessful.

Phase I (previously called Regency House project)

Phase I is med-high hostel with 32 beds. Each service user has a key worker assigned and as the hostel is 24hr Staffed, they can access more support as and when they need it. Phase I comprises of three teams of Staff specialising in mental health, substance misuse issues and providing support for ex-offenders.

The Regency is currently under a major refurbishment, which means there is a lack of beds at the moment.

Visitors are allowed but must leave the premises by 11 pm. Smoking and consuming alcohol are not permitted anywhere in the house. Residents are encoraged to use all kitchen facilities.

Glenwood lodge is a 44 bed, male only med-high hostel. Each service user has a key worker assigned and as the hostel is 24hr Staffed, they can access more support as and when they need it. The Route 1 project provides med-high support for 37 people who are mental health service users. Each service user has a key worker who they see for a minimum of 3 hrs per week.

To be eligible the service user must have a serious enduring mental health problem and cannot be using drugs or alcohol. The service user should have a Care Plan and a named Care Co-ordinator. The referral has to be a joint one between the Support Access Officer/Referrals Co-ordinator and the Care Co-ordinator.

The Resettlement project provides three mixed gender six-bed houses at:

Farm road, Hove

Stephens’s road, Brighton

Compton road, Brighton

The resettlement project provides low –med support for service users who have lived an unsettled way of life. Each client has a support worker who they see 1-4 hour’s support a week; Staff are available during office hours, based at London road. Service users must attend the weekly house meetings.

The project supports people who may have multiple needs around life skills, controlled alcohol/drug dependency and or mental health needs.

BHT has two schemes comprising of s/c units with floating support attached. The floating support can be between 1-3 hrs per week (low-med) assisting service users to live independently.

The size of the accommodation varies with bed-sits, studios and 1-bedroom flats. The support attached also varies depending on the accommodation; it will be between 1-3 hrs support a week.
